Terms of Use

1. Scope

These Terms of Use govern the use of the iOS app "local-ai-notes" (hereinafter "the App") between the user (hereinafter "you") and the provider:

By downloading, installing, or using the App, you accept these Terms of Use. If you do not agree, you may not use the App.

2. Description of the App

local-ai-notes is a note-taking app for iOS that automatically organizes your notes using machine learning. All processing takes place locally on your device. Features include:

  • Automatic clustering of notes
  • Semantic search
  • Reminders and tasks
  • Calendar integration
  • Optional: AI-powered answers via on-device language models

3. License to Use

You are granted a non-exclusive, non-transferable, revocable right to use the App for private or commercial purposes on your iOS devices under the terms of the Apple End User License Agreement (Apple EULA).

You may not:

  • Redistribute, sell, or rent the App
  • Decompile, reverse-engineer, or modify the App
  • Circumvent technical protection measures
  • Use the App for unlawful purposes

4. Data, Backups, and Data Security

4.1 Your Responsibility

The App stores all your notes and settings exclusively locally on your device. You are solely responsible for backing up your data.

The provider has no access to your data and cannot restore it in case of device loss or damage. The App provides an export function that lets you back up your notes as a JSON file (optionally encrypted). Use this regularly.

4.2 Data Loss

The provider assumes no liability for lost, damaged, or unrecoverable data caused by:

  • Loss, theft, or destruction of the device
  • Device or operating system malfunctions
  • Uninstallation of the App
  • Faulty export or import operations
  • Forgotten lock passwords (protected notes cannot be recovered if the password is lost and biometric authentication is no longer available)

5. Smart Mode (Optional AI Features)

The App offers an optional "Smart Mode" that lets you download and run an AI language model locally on your device. The following conditions apply:

  • The download requires a working internet connection and sufficient free storage (approx. 1-3 GB per model).
  • Models are provided by third parties (Google, Liquid AI) via Hugging Face.
  • AI-generated responses may be inaccurate, incomplete, or incorrect. Do not rely solely on AI-generated content for important decisions.
  • The provider makes no warranty regarding the quality, accuracy, or suitability of AI-generated responses.
  • AI-generated responses do not replace professional advice in medical, legal, financial, or safety-critical matters. Using them for such decisions is at your own risk. The provider assumes no responsibility for actions you take based on AI-generated content.

5.3 Device Resources

Using Smart Mode with on-device AI models places significant demand on device resources (RAM, CPU/Neural Engine, battery). This may result in increased battery usage, thermal performance regulation by iOS, or reduced battery life during use. This is normal behavior managed by Apple's hardware protection mechanisms. Smart Mode is optional — the app functions fully without AI models.

6. Availability of the App

The provider strives for continuous availability and functionality of the App. However, there is no claim to uninterrupted or error-free availability.

The provider reserves the right to update, modify, restrict, or discontinue the App at any time. Significant changes will be communicated through usual channels (App Store update descriptions, in-app notices).

7. Disclaimer of Liability

7.1 General Liability

The App is provided "as is", without express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement of third-party rights.

7.2 Limitation of Liability

The provider is liable without limitation only in cases of intent and gross negligence. In cases of slight negligence, liability is limited to typical, foreseeable contractual damages.

Regardless of the legal basis, the provider is not liable for:

  • Consequential damages, indirect damages, or lost profits
  • Data loss (see §4)
  • Damages caused by improper use of the App
  • Damages caused by third-party services (Apple, Hugging Face, AI model providers)

The limitations of liability do not apply to damages resulting from injury to life, body, or health, or under the Product Liability Act.

8. Intellectual Property

All rights to the App, including source code, design, logos, and trademarks, remain with the provider or their respective rights holders. You only receive the usage right described in §3.

The AI models (Gemma 3, LFM2.5) are subject to their respective license terms:

  • Gemma 3: Gemma Terms of Use (Google)
  • LFM2.5: LFM Open License v1.0 (Liquid AI — free commercial use under 10M USD annual revenue)

9. Changes to the Terms of Use

The provider may amend these Terms of Use, particularly in case of significant changes to the App or legal changes. The current version is always available in the App under "Settings → Terms of Use" and at www.local-ai-notes.de

Significant changes will be communicated in advance. If you do not agree with the amended terms, you may uninstall the App.

10. Final Provisions

10.1 Applicable Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with habitual residence in other EU member states, the mandatory provisions of consumer protection law in their country of residence remain unaffected.

10.2 Severability

Should individual provisions of these Terms of Use be or become invalid or unenforceable, the validity of the remaining provisions remains unaffected.

10.3 Apple-Specific Provisions

In addition to these Terms of Use, Apple's End User License Agreement for licensed apps applies. In case of conflicts between these Terms of Use and the Apple EULA on iOS-specific matters, Apple's provisions prevail.
